This Policy sets out, in general terms, the personal data that We collect and process, and constitutes the general agreement between the Customer and vHost with respect to the processing of personal data.<\/p><p>We recommend that the Customer carefully read the contents of this Policy in order to better understand its lawful rights and interests. The specific contents of this Policy are as follows:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-1a88cf0 e-flex e-con-boxed e-con e-parent\" data-id=\"1a88cf0\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-87c2fac elementor-widget elementor-widget-text-editor\" data-id=\"87c2fac\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>1.Types of Data Collected and Processed<\/strong><\/p><p>When the Customer searches for or registers to use products or services provided by vHost, We may collect one or more items of the Customer&#8217;s personal data, including:<\/p><p>a) Basic personal data: full name, date of birth, gender, place of birth, permanent\/temporary residential address, nationality, telephone number, identification documents (ID card\/passport number), account number, and other data necessary from time to time.<\/p><p>b) Sensitive personal data: images of the ID card\/passport, biometric data, geolocation data, order payment data, religion, ethnicity, or other data classified by law as sensitive personal data from time to time.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-0781c52 e-flex e-con-boxed e-con e-parent\" data-id=\"0781c52\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-0098fe4 elementor-widget elementor-widget-text-editor\" data-id=\"0098fe4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>2. Purposes of Collecting and Processing Personal Data<\/strong><\/p><p>1) Verifying and assessing Customer information: verifying identity, and assessing information, legal documents, and eligibility conditions for use of services in accordance with law and the requirements applicable to each specific service provided by vHost.<\/p><p>2) Performing contractual obligations and providing services to the Customer: initiating, providing, managing, renewing, modifying, suspending, or terminating services at the Customer&#8217;s request or as required by applicable regulations.<\/p><p>3) Contacting and notifying the Customer for the purpose of providing vHost&#8217;s services under the contract with the Customer.<\/p><p>4) Customer care and support: consulting, answering inquiries, providing user guidance, technical support, receiving requests, and responding to complaints from the Customer relating to vHost&#8217;s products\/services.<\/p><p>5) Marketing to the Customer the latest promotions and offers relating to vHost&#8217;s products\/services.<\/p><p>6) Preventing, detecting, and handling fraud, forgery, money laundering, or conduct showing signs of criminal activity.<\/p><p>7) Carrying out measures to ensure the security of the Customer&#8217;s data and the safety of vHost&#8217;s information systems, such as backup, monitoring, prevention, detection, and handling of fraud, cyberattacks, unauthorized access, or other risks affecting the lawful rights and interests of the Customer and of vHost.<\/p><p>8) Performing vHost&#8217;s obligations relating to inspection, audit, statistics, reporting, finance, accounting, and taxation.<\/p><p>9) Complying with applicable law on the provision of information to competent authorities.<\/p><p><strong style=\"font-size: 16px;\">3. Principles of Processing Personal Data<\/strong><\/p><p>1) Personal data is processed by vHost lawfully and transparently in accordance with applicable law.<\/p><p>2) Personal data is processed strictly for the purposes set out in Article 2 of this Policy.<\/p><p>3) The accuracy of personal data is ensured, and data is corrected, updated, or supplemented as necessary; data is retained for a period appropriate to the purpose of processing, unless otherwise provided by law.<\/p><p>4) The Customer\u2019s personal data is protected by multi-layer security measures and role-based access controls.<\/p><p><strong style=\"font-size: 16px;\">4. Legal Bases on Which vHost Collects and Processes the Customer&#8217;s Personal Data<\/strong><\/p><p>1) As required by law.<\/p><p>2) On the basis of the contract for the provision of products\/services between vHost and the Customer.<\/p><p>3) With the Customer&#8217;s consent, except where the law permits processing without consent.<\/p><p><strong>5. Methods of Collecting and Processing Personal Data<\/strong><\/p><p>5.1. Personal data that vHost may collect from the Customer in the following circumstances:<\/p><p>a) When the Customer searches for, accesses, purchases, registers for, or uses any product or service of vHost.<\/p><p>b) Through interactions between the Customer and vHost (in person, by telephone, online, via call centre systems, email, or social media channels), including customer surveys.<\/p><p>c) From sales agents or partners of vHost, or other sources to which the Customer has consented, or as otherwise permitted by law.<\/p><p>d) From automated data collection technologies.<\/p><p>5.2. Methods by which vHost processes the Customer&#8217;s personal data:<\/p><p>In its capacity as the Controller and\/or Processor of the Customer&#8217;s personal data, vHost is responsible for carrying out the following:<\/p><p>a) Establishing firewall systems and protective layers against DDoS attacks, access control mechanisms, and strictly controlling access rights for each vHost employee account when carrying out any of the purposes set out in this Policy.<\/p><p>b) Encrypting data: data is encrypted in accordance with appropriate encryption standards, where necessary, during storage or transfer, so as to ensure that data is protected, maintains its integrity, and cannot be altered after transmission, thereby minimising the risk of leakage or theft.<\/p><p>c) Monitoring and logging access history: storing and monitoring all instances of access to, modification of, or processing of personal data, so that such activity may be audited when necessary.<\/p><p><strong>6. Personal Data Will Be Shared with, or Transferred to, the Following Individuals or Organisations<\/strong><\/p><p>6.1. In order to enhance the Customer&#8217;s experience and to enable vHost to carry out the purposes of collection set out in Article 2 of this Policy, the Customer agrees that vHost may share or transfer the Customer&#8217;s personal data to:<\/p><p>a) vHost&#8217;s employees.<\/p><p>b) vHost&#8217;s member companies and affiliated units.<\/p><p>c) vHost&#8217;s business partners, sales agents, and service providers (transportation, delivery, telecommunications, payment, etc.).<\/p><p>d) Competent state authorities, upon lawful request.<\/p><p>e) Other third parties as consented to or designated by the Customer from time to time.<\/p><p>6.2. vHost may transfer the Customer&#8217;s personal data across borders in order to carry out the purposes set out in Article 2 of this Policy, in compliance with law and with the requirements applicable to Cross-Border Data Transfer Impact Assessments, to:<\/p><p>a) Internet Corporation for Assigned Names and Numbers (ICANN), international domain name registrars.<\/p><p>b) Partners providing infrastructure, Data Center, and other services.<\/p><p><strong>7. Processing or Sharing of the Customer&#8217;s Personal Data Without the Customer&#8217;s Consent<\/strong><\/p><p>1) In urgent cases to protect the life, health, honour, dignity, or lawful rights and interests of the Customer or of other persons.<\/p><p>2) To address an emergency situation, or a threat to national security that has not yet reached the level requiring a declared state of emergency, or to prevent riot, terrorism, crime, or violations of law.<\/p><p>3) To serve the operations of state authorities or state administrative activities in accordance with law.<\/p><p>4) To perform an agreement between the Customer and a relevant agency, organisation, or individual in accordance with law.<\/p><p>5) Where such personal data has been lawfully made public.<\/p><p><strong>8. Location of Storage, Retention Period, and Deletion of the Customer&#8217;s Personal Data<\/strong><\/p><p>8.1. Storage location<strong>: <\/strong>vHost stores the Customer&#8217;s personal data on Our server systems, on the principle of ensuring information security and preventing data leakage or disclosure.<\/p><p>8.2. Retention period<strong>: <\/strong>from the time vHost receives personal data provided by the Customer until the purposes set out in Article 2 of this Policy have been fulfilled.<\/p><p>vHost may need to retain the Customer&#8217;s personal data even after the contract between vHost and the Customer has been terminated, in order to perform Our legal obligations under applicable law and\/or at the request of competent state authorities.<\/p><p>8.3. <strong>Deletion and destruction of personal data: <\/strong>Upon the Customer&#8217;s termination of use of vHost&#8217;s products\/services and upon a valid request, We will delete all personal data that the Customer has provided and\/or that We have collected in the course of the Customer&#8217;s use of the products\/services, except as otherwise provided by law or in certain cases where this cannot be carried out, as set out in Article 7 of this Policy.<\/p><p>Where personal data cannot be deleted or destroyed for a legitimate reason after receipt of the Customer&#8217;s request, We will notify the Customer accordingly.<\/p><p><strong>9. Rights and Obligations of the Customer with Respect to Personal Data<\/strong><\/p><p>9.1. Rights of the Customer:<\/p><p>a) Right to be informed: the Customer has the right to be informed of vHost&#8217;s personal data processing activities under this Policy, except as otherwise provided by law.<\/p><p>b) Right to consent: the Customer has the right to decide on consent relating to the processing of its personal data, except as otherwise provided by law.<\/p><p>c) Right to access and correct personal data: the Customer has the right to access, view, and correct its personal data through the account provided by vHost, or to send a request to vHost to correct data that cannot be self-corrected, except as otherwise provided by law. The Customer shall be solely responsible for the information whose correction it requests.<\/p><p>d) Right to request the provision of personal data: the Customer has the right to request vHost to provide its personal data by sending a valid written request to vHost.<\/p><p>e) Right to restrict processing of personal data: the Customer has the right to request vHost to restrict the processing of its personal data, except as otherwise provided by law.<\/p><p>f) Right to withdraw consent: the Customer has the right to request the withdrawal of its consent to any processing purpose it had previously agreed to permit vHost to carry out, except as otherwise provided by law. Upon receiving such a request, We will notify the Customer of the consequences and potential risks and damages that may result from the withdrawal of consent.<\/p><p>Where the Customer&#8217;s withdrawal of consent affects the performance of the contract between vHost and the Customer, vHost&#8217;s legal obligations, the life, property, or lawful rights and interests of the Customer or of other organisations or individuals, or the task of protecting national security and social order and safety, vHost shall have the right to suspend or terminate the service contract between vHost and the Customer. We shall bear no legal liability, and shall not be obliged to compensate, for any loss arising to the Customer in such case.<\/p><p>g) Right to delete or request the deletion of data: the Customer has the right to delete or request the deletion of its personal data in accordance with Clause 3, Article 8 of this Policy.<\/p><p>h) Right to lodge a complaint or bring legal proceedings in accordance with law, where the Customer considers that its right to protection of personal data has been infringed.<\/p><p>i) Other rights as provided by law from time to time.<\/p><p>9.2. Obligations of the Customer:<\/p><p>a) To comply with the provisions of law, this Policy, and vHost&#8217;s regulations and instructions relating to the processing of the Customer&#8217;s personal data.<\/p><p>b) To provide complete, truthful, and accurate personal data and other information as required by vHost upon registering for and using Our products\/services, and upon any change to such information. vHost shall secure the Customer&#8217;s personal data on the basis of the information provided by the Customer; accordingly, if any information proves inaccurate, vHost shall bear no liability where such inaccuracy affects or restricts the Customer&#8217;s rights and interests. Where the Customer fails to notify Us of a change and any risk or loss arises as a result, the Customer shall be responsible for any error or act of exploitation or fraud occurring during use of the service due to its own fault, or due to its failure to provide accurate, complete, and timely updates to its information, including any financial loss or cost arising from incorrect or inconsistent information provided.<\/p><p>c) To cooperate with vHost, competent state authorities, or third parties in the event any issue arises affecting the Customer&#8217;s personal data.<\/p><p>d) To protect its own personal data, and to proactively apply measures to safeguard its personal data while using vHost&#8217;s products\/services; and to promptly notify vHost upon discovering any error or discrepancy in its personal data, or upon suspecting that its personal data is being compromised.<\/p><p>e) To be solely responsible for any information, data, or consent that it creates or provides in the online environment, and to be solely responsible where personal data is leaked or compromised due to its own fault.<\/p><p>f) Where the Customer collects, stores, processes, or transmits the personal data of any third party (including, without limitation, end users, the Customer&#8217;s own customers, employees, or partners) on vHost&#8217;s infrastructure or systems, or through vHost&#8217;s services, the Customer shall be solely responsible for the collection, processing, and protection of such third party&#8217;s personal data, and undertakes to indemnify and hold Us harmless against any claim, lawsuit, dispute, loss, cost, or administrative penalty arising from any end user or competent state authority as a result of the Customer&#8217;s breach of end-user data protection requirements on vHost&#8217;s systems.<\/p><p>g) To keep itself regularly updated on vHost&#8217;s regulations and Personal Data Processing Policy, as notified to the Customer from time to time or as posted on vHost&#8217;s official website (vHost.vn).<\/p><p>h) Other obligations as provided by law.<\/p><p><strong>10. Potential Unintended Consequences and Damage<\/strong><\/p><p>10.1. vHost employs various information security technologies to protect the Customer&#8217;s personal data against unintended exploitation, use, or disclosure. However, We cannot guarantee the absolute security of the Customer&#8217;s personal data in certain cases, including:<\/p><p>a) Hardware or software errors occurring during the processing or sharing of data that result in loss of the Customer&#8217;s data;<\/p><p>b) Security vulnerabilities beyond vHost&#8217;s control, or the system being attacked by hackers, resulting in data leakage or disclosure;<\/p><p>c) The Customer&#8217;s own negligent disclosure or leakage of personal data due to carelessness, being defrauded, or accessing websites or downloading applications containing malicious software;<\/p><p>10.2. vHost recommends that the Customer keep its login credentials, OTP codes, and biometric information <strong>confidential<\/strong>, and refrain from sharing such information with any other person.<\/p><p>10.3. The Customer should safeguard its electronic devices during use, and should lock, log out of, or exit the account provided by vHost when it is not in use.<\/p><p>10.4. In the event of an incident, or the detection of a violation affecting the Customer&#8217;s personal data, vHost shall, within no more than 72 hours from the time the violation is detected, notify the affected Customer and\/or the competent state authority, as applicable, while concurrently endeavouring to implement remedial measures to prevent further consequences.<\/p><p><strong> Contact Information<\/strong><\/p><p>Should the Customer have any inquiry or request relating to its personal data, please contact vHost using the following details:<\/p><p>Hotline: 19006806 (VND 1,000\/minute)<\/p><p>Email: <a href=\"mailto:sales@vHost.vn\">sales@vHost.vn<\/a><\/p><p>Contact address: 2<sup>nd<\/sup> Floor, 46 Cuu Long Street, Tan Son Hoa Ward, Ho Chi Minh City.<\/p><p><strong> General Provisions<\/strong><\/p><p>1) The Customer understands and agrees that this Policy may be amended from time to time and shall be notified to the Customer through vHost&#8217;s transaction and communication channels. Any changes, together with their effective dates, will be updated and published on vHost&#8217;s website and other channels (if any). The Customer&#8217;s continued use of vHost&#8217;s products\/services after the notice period for any such amendment or supplement shall be deemed the Customer&#8217;s acceptance of such amendment or supplement, except where the amended content requires the Customer&#8217;s clear and separate consent under law, in which case vHost shall obtain such consent in an appropriate manner.<\/p><p>2) This Policy shall be interpreted and governed by the laws of Vietnam. Any dispute arising in connection with this Policy shall first be resolved through negotiation and conciliation. Where no agreement is reached, the dispute shall be submitted to the competent People&#8217;s Court for resolution.<\/p><p>3) This Policy also constitutes a Notice of Personal Data Processing in accordance with applicable law. The Customer undertakes that it has read and fully understood, and agrees to, the entire content of this Policy without qualification.<\/p><p>4) This Policy is publicly posted by vHost on the website vHost.vn so that both Parties are clearly informed. The Parties agree that they have carefully read and understood their respective rights and obligations and agree to the entire content of this Policy.
